What may be new to many is that Art Soiree intends to do some construction on site to meet their needs and those of the neighbors. In order to fully utilize their third floor space, they intend to build out and create additional indoor space to allow for storage and more restrooms. As I’ve said before, no part of their operation will be outdoors and I’m pleased that their construction will keep all of their patrons inside – especially given how close the rear of the business is to residents.
I’ve been working with Art Soiree, neighbors on T Street and Swann Street and the Shaw Dupont Citizens Alliance to develop a Settlement Agreement, or enforceable contract signed by all parties and attached to the liquor license. The agreement mitigates potential issues such as trash collection and rat abatement, noise from patrons and entertainment, hours of operation, and parking and valet operations.
I’m seeking your input on this draft settlement agreement this week so that we can move on the agreement before an additional ABC Board hearing. Here are some key points:
· The entirety of the operations are inside and doors and windows must remain closed at all times except ingress and egress.
· Any live entertainment must end 90 minutes prior to closing - this means 1230am on weeknights and 130am on weekends. The establishment may remain open until 3am on the weekends.
· Trash and particularly glass bottles cannot be disposed of outside between the hours of 9:30pm and 8:00am.
· New construction is required to include noise cancelling insulation (this is what will face westward).
